These Terms of Use ("Terms") govern your access to and use of onetreehealth.com and our "Request a Callback" / patient-assistance intake form (together, the "Services"), operated by One Tree Health ("One Tree Health," "we," "us," "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Not medical advice
The Services provide general information and a way to request a conversation with our team. Content on the Site is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with questions about a medical condition. Using the Services does not create a provider-patient relationship; that relationship begins only when you are formally accepted as a patient.
2. Not legal advice; we are not a law firm
One Tree Health is not a law firm and does not provide legal advice or representation. Submitting the intake form does not create an attorney-client relationship with any law firm, and we do not name, rank, recommend, or guarantee any specific attorney or outcome. If you ask us to, we will share a list of personal-injury law firms we work with, or — only with your separate authorization — share your information with those firms so an interested firm may contact you. Any decision to retain a lawyer, and any resulting relationship, is solely between you and that lawyer.
3. Emergencies
The Services are not for emergencies. If you are experiencing a medical emergency, call 911 immediately. Do not use the intake form to seek urgent or emergency care.
4. Eligibility
You must be 18 years of age or older and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements.
5. The intake form and communications
When you submit the intake form, you agree that the information you provide is accurate and that you are the person (or an authorized representative) associated with the contact details given. Your authorization for us to contact you by phone and text is governed by the consent you provide on the form and described in our Privacy Policy. We do not guarantee that any law firm will contact you, accept your matter, or provide any particular result.
6. Acceptable use
You agree not to: use the Services for any unlawful purpose; submit false, misleading, or another person's information without authorization; interfere with or disrupt the Services or attempt to gain unauthorized access; upload malicious code; scrape, harvest, or collect data from the Services without permission; or use the Services to send spam or unsolicited communications.
7. Intellectual property
The Site and its content (text, graphics, logos, and design) are owned by or licensed to One Tree Health and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works without our written permission.
8. Third-party links and services
The Services may link to or rely on third-party websites and tools (for example, law-firm websites, mapping, appointment, or payment services). We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their terms and policies.
9. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that information on the Site is complete or current.
10. Limitation of liability
To the fullest extent permitted by law, One Tree Health and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Services.
11. Indemnification
You agree to indemnify and hold harmless One Tree Health from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or violation of these Terms.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws rules.
13. Changes to the Services and these Terms
We may modify or discontinue the Services and may update these Terms from time to time. Changes are effective when posted with a new "Last updated" date; your continued use means you accept the updated Terms.
14. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Notice of Privacy Practices, are the entire agreement between you and One Tree Health regarding the Services.
